The cracked wheels might not have been spotted on the mot. My car passed earlier this year with a cracked alloy, it can be difficult to spot without the tyre off the rim. It could have been an honest mistake, just sayin...
 
This is from BMW. Its part of what they do now. Pointing out the failures so there can be no doubts

That specialist I use does the same thing, you can sit and watch it live in the reception area if you wish

One of our mail exchanges, I received this;
"The car is available. Everything is present and correct on the car, all in working order with no faults. We've just had it serviced at a local BMW specialist who have given it a clean bill of health. It's MOT is due next week and we have it booked in to have that done so will come with a full year for the new owner.

Cosmetically the car is in very good shape for a 10 year old example with only small, minor surface scratches here and there. Nothing that would justify any paintwork needed. Alloy wheels are in good shape and all 4 tyres are brand new."




The sale of goods act states "You are entitled to expect that the vehicle is 'as described’."

Original sales blurb;
"330i MSport With Sat Nav in fantastic condition. Full main dealer and specialist service history. Just had major service inc new brakes and 4 new Bridgestone tyres. "

I don't fully know what I can get out of this but it's worth trying.
 
I'd send him a link to the video from the workshop and ask if he sold you the wrong car by mistake?
 
LOL - yeah I've sent it all...He can only deny all the fault weren't there 89miles before hand...
 
I know chap. In which case why would you sell it with defective ones?

Well...I have a reply.

Lots of mitigation, not me your honour...ends with him saying I'll ask the trouser wearer as I think you've got a point.

"I will discuss this with my wife this evening. She may be willing to contribute to some of the costs as a show of goodwill. I'll come back to you once I've had the chance to talk this through with her."
 
BTW he totally coughs to it having an oil leak and part worn tyres...and he knew about the weld on the wheels. :)
 
See what happens Alex... contribution to the rims, attend to the seals and a proportionate contribution to the water pump I'd say.

Won't hold my breath she refused anything more that ?45 off the purchase price. Zero negotiation.
