ive had a problem with my exhaust touching my trouser when stopped on bike see pics below could some one advise me or post a pic off how close there can is the the swing arm see my picture

That looks about right to me, you can't really go wrong with the fitment or the support bolt holes don't line up.

That is a normal occurrence with water proofs of Textiles done it before my self.. I have the same Exhaust myself and looks like it fits perfect to me?

That will burn off or remove with Scotchbrite..
