I agree with JimmyMac, you should go to dealer who sold it to you who should sort it out. Your contract is with them. If they want to recover costs from BMW that's between them & BMW.
 
Be careful about taking it elsewhere now to sort. If you do and it costs say ?1000, both BMW and where you bought it from can say they won't pay as you have not given them sufficient opportunity to repair / replace.

A 7 year old bike that hasn't been serviced to schedule, I'd say there's no chance of goodwill from or judgement against BMW.
