checking oil level question

hello.checking oil as manual states i.e. bike up to temperature after ride,idle for 1 minute whilst bike is upright,switch off engine and check level.now when i do this the oil level is sitting approx 3 mm above the minimum level but if i wait a small amount of time (approx 20-50 seconds) the oil level rises significantly to about the 3/4 full mark (presume oil returning to sump with engine off).the question is what level do you take as being correct?.any help appreciated.thanks.andy.

I work off the latter when the bike has been stood for a minute.

Like Soof, work off the latter. But then won't do any harm to top it up to the maximum mark. That way your covered either way.
