As it stands it has baffle out with decat, will it fail? I assume at the very least baffles need to be in?

Decat & MOT pass or fail?
To pass an MOT you need a road homologated silencer (E stamp) and if the silencer has accommodation for a baffle it should be fitted.
The decat is of no concern.
